1. General Notes
- 1.1 Your On-Line Responsibility Code
("YORC") sets forth how the Outdoor
Independence Taining Center (OITC) will
operate the OITC World Wide Web site,
and how OITC members may use this
website. Please read this document
carefully, and refer to it as necessary.
- 1.2 The purpose of YORC is to make the
OITC website informative, interesting,
interactive and even entertaining. We
want to foster a free exchange of ideas
concerning OITC, teaching and adaptive
outdoor recreation which incorporates
respect for organizations, agencies,
businesses, associations, and individuals.
2. Accessing and Using the OITC
Website
- 2.1 Access.
- 2.1.1 Equipment. Each person who
accesses the OITC website is solely
responsible for equipment used to
provide such access. OITC does not
have the expertise or the staffing to
respond to technical questions
regarding difficulties in obtaining
access to this site. Those persons
having such difficulties should contact
their hardware or software vendor,
online service provider, or Internet
service provider.
- 2.1.2 Access Charges. Each person
who accesses the OITC website is
soley responsible for any telephone
charges, online charges, or other
expenses in obtaining access to the
site.
- 2.2 Security.
- 2.2.1 Access Rights. Access to certain
portions of the OITC website is limited
to OITC Members. The right to access
these protions is demonstrated through
use of the Member's name and OITC
membership number (which can be
found on the registration card).
- 2.2.2 Assumption of Public
Knowledge. Those who post materials
and information to the OITC website
must assume that these things can be
accessed and reviewed by anyone who
has access to the World Wide Web.
While OITC has taken reasonable
precautions to limit unauthorized
access, please rember that there are
those with a lot of talent and time who
canhack into even the best maintained
systems. DO NOT POST
ANYTHING WHICH MAY LATER
PROVE AN EMBARRASSMENT
TO YOU!
3. Online Conduct
- 3.1 Code of Conduct and
Grievance Procedures.
- 3.1.1 Code of Conduct. All acts and
postings by OITC Members to this
website are subject to this OITC
on-line code of Conduct (YORC).
While OITC Members are subject to
the Code, no proceedings under the
Code of Conduct are required to
suspend, terminate, or otherwise limit
a Member's privileges on the OITC
website. An OITC Member aggrieved
by any such suspension, termination,
or limitation may appeal such a
decision to the OITC President.
- 3.2 General Guidelines. The OITC
website is a service for the membership of
OITC Mission Statement and Strategic Plan.
Our goal is to provide an interesting,
stimulating, educational and entertaining
place for all OITC Members to exchange
thoughts and ideas concering OITC, and
adaptive outdoor recreation. Using vulgar,
abusive or hateful language undermines this
goal and is not allowed. Please use best
judgment, be civil and polite, and be
respectful of other OITC Members. If an
OITC Member or other user uses vulgar or
abusive language online, even if masked by
symbols or other characters, that person
may be subject to disciplinary action.
- 3.3 Limitiations. Without limiting the
application of the Code of conduct and
YORC, no person may use or psot materials
to this website to:
- 3.3.1 harass, threaten, embarrass or
cause distress, unwanted attention
or discomfort to another OITC
Member or user of this website or
other person or entity. When an
OITC Member targets another
individual or entity to cause distress,
embarrassment, unwanted attention, or
other discomfort, this is harassment.
OITC does not condone harassment in
any form may suspend or terminate
the privileges of any Member who
harasses others. People may from time
to time be in disagreement with
someone's point of view -- we
encourage lively discussion in our
electronic forums -- but personal
attacks, or attacks based on aperson's
race, national origin, ethnicity, religion,
gender, disability, or other basis
prohibited by law or the Code of
Conduct, are prohibited. Those who
disagree with someone's point of view
must address the subject, not the
person.
- 3.3.2 post or transmit sexually
explicit images or other content
which is deemed ny OITC to be
offensive. OITC prohibits the transfer
or posting on this website of sexually
explicit images or other content
deemed offensive by OITC.
- 3.3.3 transmit any unlawful,
harmful, threatening, abusive,
harassing, defamatory, vulgar,
obscene, hateful, racially, ethnically
or otherwise objectionable Content.
- 3.3.4 impersonate any person,
including but not limited to, an
OITC official or an information
provider, forum leader, guide or
host, or communicate under a false
name, a name that the user is not
entitled or authorized to use. This
can involve the portrayal of another
person or entity, such as the
impersonation of OITC directors,
officers, members, or staff, or an
information provider, authorized guide
aor host, or communication under a
false name or a name that a user is not
authorized to use. Members must
avoid the deceptive portrayal of OITC
personnel or other persons in all forms
of online communication, including,
without limitation, message postings.
- 3.3.5 post or transmit chain letters
or pyramid schemes. Transmission of
chain letters or pyramid schemes of
any kind is not allowed on this
website. this material places an
unnecessary load on the OITC website
system and is considered a nuisance by
many OITC Members. Certain chain
letters and pyramid schemes are illegal.
Letters or messages that offer a
product or service based on the
structure of a chain letter are also of
questionable legality. At minimum,
they are a waste of resources and are
not permittedon the OITC website.
- 3.3.6 post or transmit any
unsolicited advertising, promotional
materials, or other form of
solicitation to other OITC
Members, individuals or entities.
Users may not use the OITC website
to send unsolicited advertising,
promotional material, or other forms of
solicitation to other OITC Members.
No one may use the OITC website to
collect or "harvest" names or other
information concerning OITC
Members without the expressed prior
permission of the Member. OITC
reserves the right, but does not assume
the obligation, to block or filter mass
e-mail solicitations on or through the
OITC website.
- 3.3.7 intentionally or
unintentionally violate any
applicable local, state, national or
international law, including but not
limited to any regulations having
the force of law.
- 3.3.8 post or transmit defamatory
material, or material which invades
the privacy of another.
- 3.4 Reporting Violations. If an
OITC Member witnesses activity in a forum
that he or she thinks may violate the OITC
YORC, the member is requested to send an
e-mail detailing the possible violation to
OITC@therapeuticadventures.com.
4. Content
- 4.1 OITC Role.
- 4.1.1 Limits on OITC Role. OITC
Members recognize that
communication on this website posted
on one of the website's electronic
forums, and OITC cannot, and does
not intend to screen communication in
advance. Moreover, because OITC
encourages open and candid
communication, it cannot determine in
advance the accuracy, or conformance
the OITC YORC of Content posted or
transmitted on the OITC website.
OITC is not responsible for screening,
policing, editing, or monitoring such
Content. If notified of Content which
is alleged not to conform to PSIA
YORC, OITC may investigate the
allegation and determine in good faith
and in its sole discretion whether to
remove or request the removal of such
Content from the OITC website.
OITC shall have no liability or
responsiblility to anyone in respect of
performance or non-performance by
OITC of such activities.
- 4.1.2 Material Not Verified. The
material posted and the opinions
expressed by OITC Members and
others on the OITC website are not
checked for accuracy, and are not
necessarily those of OITC, its
directors, officers, or staff.
- 4.2 Use of Judgment. All OITC
Members must use their best judgment in
evaluating all information contained or
opinions expressed on the OITC website.
Those who access the OITC website should
be no less careful in their evaluation of such
information and opinions as they are in
everyday life. It is OITC's policy not to
endorse, oppose, or edit any opinion
expressed by an OITC Member or
information or material provided by such
OITC Members or others, or other
indepenent party, so as they conform to
YORC.
- 4.3 Copyright.
- 4.3.1 Content Copyrighted. All
Content is protected by copyright
pursuant to U.S., international
conventions, and other copyright laws
as a collective work and/or
compilation, and OITC owns a
copyright in the selction, coordination,
arrangement and enhancement of such
Content. Users may not modify,
publish, transmit, participate in transfer
or sale of, reproduce (except as
provided below), create derivative
works from, distribute, perform,
display or in any way exploit, any
Content, in whole or in part, provided
that if no specific restrictions are
applied directly or indirectly in relation
to a particular item of Content, a user
may make a reasonable number of
copies of such items including
copyright material, provided that the
copies are made and used only for the
user's personal use and that the user
ensures that any notices contained in
the Content such a copyright,
trademark, and other proprietary rights
notices are reproduced in an
unmodified form in all such copies.
- 4.3.2 Postings. OITC Members may
post to the OITC website only Content
that is not subject to any copyright or
other proprietary rights protection
(collectively, "Public Domain
Content"), or Content in respect of
which the holder of any copyright,
trademark, or other proprietary rights
("Rights") has given expressed
authorization for distribution on the
OITC website without any restriction
whatsoever, and in respect of which
any moral rights of any person or
entity have been completely and
irrevocably waived. Any copyright
Content submited with the consent of
a copyright owner should contain a
phrase such as "Copyright owned by
(name of the owner); Used by
Permission." The unauthorized
submission of copyright or Consent
which is otherwise subject of any third
party Rights constitutes a breach of the
OITC YORC, and may also render the
submitted liable to the holder of such
rights. The poster, not OITC or its
affiliates or independent contractors, is
exclusively responsible for any liability
resulting from infringement of Rights
arising from such submission or
transmission.
- 4.3.3 Assignment of Rights by
Posting. By submitting Consent to any
"Public Area" (Public Area(s) are those
areas of the OITC website that are
generally accessible to others, such as
forums), those who post information
are deemed automatically to grant --
and/or warrant that the holder of any
Rights or Moral Rights in such Content
has completely and effectively waived
all such Moral Rights and expressly,
validly and irrevocably granted to the
poster the right to grant -- OITC the
royalty-free, perpetual, irrevocable,
non-exclusive right (including any
moral rights) and license to use,
reproduce, modify, adapt, publish,
translate, create derivative works from,
distribute, perform and display the
Content whole or part) worldwide
and/or to incorporate it in other works
in any form, media, or technology now
known or hereafter developed for the
full term of any Rights that may exist
in such Content. The rights required
also permit any person to access, view,
store and reproduce the Content for
personal use. Subject to the foregoing,
the owner of Content placed on the
OITC website retains any and all rights
which may exist in such Content.
